DOL releases updated FMLA Employee Rights Poster

The Labor Department has released a new poster, Your Employee Rights Under the Family and Medical Leave Act, to replace the prior April 2016 poster. It can be found in PDF format for printing here.
The new poster, revised as of April 2023, is intended to be more user-friendly. It answers these common questions:
- What is FMLA leave?
- Am I eligible to take FMLA leave?
- How do I request FMLA leave?
- What does my employer need to do?
The poster should be placed in a conspicuous location in the workplace where notices to employees are customarily posted. Employers should also post the notice digitally on the company’s intranet. A poster must be displayed at all locations, even if no employees are eligible for FMLA leave at that site.
While employers should replace the poster as soon as possible, the April 2016 and February 2013 versions still fulfill the posting requirement. The U.S. Equal Employment Opportunity Commission (EEOC) is in the process of updating its “Know Your Rights” poster to address the Pregnant Workers Fairness Act, which goes into effect on June 27, 2023. Employers may wish to defer purchasing a new vendor-created poster until after the EEOC releases its updated poster.
